Multiple DUI charges carry heavier sentencing than a 1st DUI offense.
In order to ensure that your freedom is not restricted and your rights are protected, you need an attorney who can provide effective defense strategies to minimize penalties or fight for case dismissal.
In any DUI case, even if it’s your 2nd DUI or 3rd DUI, aggravating factors can make these sentences even more severe. For example, if you were driving with an individual under the age of sixteen, or if you registered a blood alcohol content (BAC) level of above 15%, you could be facing additional fines and longer jail sentences.
QUESTION 01
7-YEAR LOOKBACK PERIOD
In order to be sentenced for multiple DUI offenses, prior convictions must have occurred within a period of time known as the “lookback period.” In Washington, this is a period of seven years within which convictions can be considered during sentencing.
Any additional convictions outside of the seven-year lookback period cannot be considered relevant in your evaluation.
QUESTION 02
Under Washington law, a DUI may be charged as a felony when an individual has three or more qualifying prior offenses within 15 years. Certain previous convictions, including vehicular assault or vehicular homicide involving impaired driving, may also result in felony DUI charges.
Unlike misdemeanor DUI offenses, felony DUI charges carry significantly more severe consequences, including the possibility of substantial prison time, significant fines, and long-term impacts on employment and driving privileges.
Because of the seriousness of these charges, experienced legal representation is essential to protecting your rights and evaluating your defense options.
QUESTION 03
In Washington, the Deferred Prosecution program allows certain offenders diagnosed with alcohol addiction who have accepted the need for treatment to undergo a two year treatment program.
Upon successful completion of the program, the DUI charge is dismissed.
Although the program is generally used for DUI cases, it may also apply to certain offenders with drug addictions. Washington State law now allows individuals to pursue a second deferred prosecution for DUI or Physical Control charges under certain circumstances. This change provides an additional opportunity for eligible individuals who previously would have been limited by the state’s once-in-a-lifetime rule. However, eligibility remains subject to strict legal requirements, including the nature of the current charge and the individual’s prior history.
