SPOKANE, WA · FELONY DUI
CLASS B FELONY
Most DUIs in Washington are gross misdemeanors. A DUI can be charged as a felony when the person has several prior DUI-related offenses within the look-back period set by state law, or has a prior conviction for felony DUI, vehicular homicide or vehicular assault while under the influence.
Felony DUI is a Class B felony. A conviction can mean prison time, a permanent felony record, a long license revocation and years of ignition interlock requirements.
Because the charge depends on your prior record, the first step is often to examine whether each prior offense legally counts. Prior convictions are not always what they appear to be on paper.
Chris Bugbee has handled nearly 200 jury cases and brings 30+ years of criminal law experience to every felony he defends.
As a former Spokane County prosecutor, he knows how felony DUI cases are charged and how to test the State’s evidence at every stage.
WHAT TO KNOW
A felony DUI defense examines both the new arrest and the prior offenses the State relies on. Weaknesses in either can change the charge.
The same challenges that apply to any DUI — the stop, the testing and your rights — still apply in a felony case.
If a prior offense does not legally qualify, the charge may not be a felony at all.
